A Munka Törvénykönyv változásai 2011. augusztus 1-én lépnek érvénybe, kivéve a munkaerő-kölcsönzésre vonatkozó szabályok, mert ezek 2011. december 1-étől hatályosak.
A változással érintett területek:
• Próbaidő
• Egyszerűsített foglalkoztatás
• Csúsztatás
• Újra munkába állás GYES, GYED után
• GYES, GYED idejére járó szabadság
• Szabadság pénzbeli megváltása
• Szabadság kiadása, ha az esedékesség éve lejárt
• Munkaerő-kölcsönzés

I. PRÓBAIDŐ
Munka törvénykönyve (Mt.) változás 2011. augusztus 1-től a próbaidő kapcsán:
Marad a 3 hónap maximális próbaidő mértéke 2011. augusztus 1. után is, abban az esetben, ha munkáltatónál nincs kollektív szerződés, és nem tudják belevenni azt, hogy megnövelik a próbaidő mértékét maximum 6 hónapra.
Fontos! A 3 hónap próbaidő nem egyenlő 90 nap próbaidővel! Mert 91 - 92 nap is lehet, ezért szokták a munkáltatók inkább ezen megfogalmazást alkalmazni.

II. EGYSZERŰSÍTETT FOGLALKOZTATÁS
Amennyiben kitöltik az Egyszerűsített foglalkoztatási szerződést (Blanketta Szerződést), nem kell munkaidő nyilvántartást (jelenléti ívet) vezetniük az egyszerűsített foglalkoztatottaknak (alkalmi munkásoknak) 2011. augusztus 1-től, amennyiben a felek írásban kötöttek munkaszerződést.
Nem jár továbbá szabadság az egyszerűsített foglalkoztatottaknak 2011. augusztus 1-től.
„(3) Egyszerűsített foglalkoztatás esetén nem kell alkalmazni az Mt.-nek a szabadság kiadására vonatkozó 134. §-át.”
Bővült a mezőgazdasági idénymunka köre az egyszerűsített foglalkoztatás kapcsán 2011. augusztus 1-től.

III. CSÚSZTATÁS
Az új szabály alapvetően az eddig jogszabály ellenesen alkalmazott “csúsztatást” kodifikálja, azaz teszi jogszerűen alkalmazhatóvá. Ha a munkavállaló egyik nap többet dolgozott, akkor nem kaphatott helyette szabadidőt és ki kellett fizetni túlóraként.
2011. augusztus 1-től a munkáltató előírhatja, hogy a pótlék (50%-os túlórapótlék) helyett szabadidőt ad. Amennyiben a munkavállaló ma többet dolgozott pl. 2 órával, holnapután annyival később jön be dolgozni vagy hamarabb hazamegy, nem kell túlórát fizetni.
Fontos azonban, hogy ezzel a munkaidő nyilvántartásra is jobban oda kell figyelni!

IV. ÚJRA MUNKÁBA ÁLLÁS GYES, GYED UTÁN
Nem volt szabályozva eddig, de a munkavállalónak egy hónappal előzetesen kellett volna bejelentenie szándékát, hogy újra munkába szeretne állni a GYES vagy GYED lejárata után.
Ez a gyakorlatban úgy történt, hogy a munkavállaló megjelölt egy időpontot, amit a munkáltatónak el kellett fogadni, ha akarta, ha nem.
2011. augusztus 1-től szabályozásra került, hogy a GYES vagy GYED után újra munkába álló munkavállaló, ha a fizetés nélkül szabadság kezdetétől számított hat hónap elteltével kíván munkába állni, a szándékát legalább 60 nappal előtte közölnie kell.
Ha a munkavállaló a fizetés nélküli szabadság kezdetétől számított hat hónap letelte előtt kíván munkába állni, a szándékát legalább 30 nappal előtte közölnie kell.

V. GYES, GYED IDEJÉRE JÁRÓ SZABADSÁG
Bizonyára mindenki tudja, hogy a szülési szabadságot követően az anyukának minden gyereke után a GYES vagy GYED első évére járt a szabadság.
Az egy éves szabadsággal érintett időszak 2011. augusztus 1-től fél évre (6 hónapra csökken) ez sokkal kedvezőbb a munkáltatók terheit tekintve és talán több anyuka foglalkoztatását vállalják a jövőben.

VI. SZABADSÁG PÉNZBELI MEGVÁLTÁSA
A szabadság pénzbeli megváltása tilos!!!
De 2011. augusztus 1-től lehetőség van arra, hogy a GYES-ről, GYED-ről újra munkába álló munkavállaló, a fél éves időszak(ok) ideje alatt felhalmozott szabadságát, a munkáltató kifizesse.
Ezen szabadságok pénzbeli megváltására írásos megállapodás kell készüljön a munkáltató és munkavállaló között.
Nagyon fontos, hogy továbbra sem váltható meg pénzben az egyéb jogcímen felhalmozódott szabadság.

VII. SZABADSÁG KIADÁSA, HA AZ ESEDÉKESSÉG ÉVE LETELT
A szabadságokat esedékességük évében ki kell adni!!!
Ha a munkavállaló 183 napot meghaladó ideig van betegállományban vagy GYES-en, GYED-en, stb. van, ha újra munkába áll 183 napon belül ki kell adni az előző évi szabadságait.
Ha 183 napnál kevesebb ideig van betegállományban, akkor a munkába állást követő 30 napon belül kell kiadni az előző évi szabadságait.

VIII. MUNKAERŐ-KÖLCSÖNZÉS
Maximalizálták egy munkavállaló kölcsönzési idejét. Egy munkavállalót maximum 5 évig lehet kölcsönözni. Utána a munkavállaló a kölcsönbevevő alkalmazásában tudja folytatni munkaviszonyát.
Amennyiben a kölcsönbevevő meg kívánja tartani a kölcsönbe vett munkavállalót és saját maga alkalmazza a továbbiakban, valamint a kölcsönbeadóval kötött megállapodásban szabályozták a közvetítési díjat, akkor a kölcsönbevevőtől közvetítési díjazásra jogosult a kölcsönbeadó.
